Amendments of confirmed holiday arrangements incur a charge of NZ$50 per file if
made at least 30 days prior to arrival or NZ$100 per file if within 30 days of
arrival. Additionally, any supplier charges will also be levied, regardless of
how close to arrival the amendment is made. Please note that once ticketed, the
flight portion of the itinerary is non-refundable and non-transferable in the
event of amendment.
A cancellation fee of NZ$100 per person is applicable once a booking has been
confirmed. In addition to this, any supplier charges will also be levied. Please
note that once ticketed, the flight portion of the itinerary is non-refundable
in the event of cancellation.
If you are unhappy about any aspect of your holiday, please inform our local
representative or Agent immediately who will do everything possible to resolve
the problem on the spot as it may prove difficult to take any effective action
upon your return.
A non-refundable deposit of NZ$100 per person is required at the time of
confirmation to ensure your booking is held. If a deposit is not received within
7 days, your booking may be cancelled. Should your booking be made within 30
days of departure, full payment is due immediately upon confirmation. A fee of
NZ$30 applies to all bookings made less than 7 working days prior to departure.
Payment of the deposit will indicate acceptance of these booking conditions.
Final payments are due to reach Ski Express at least 30 days prior to travel or
immediately if booking is made within 30 days prior to travel. Travel documents
will not be released until full payment is received.
Bookings made within 7 days of departure incur an additional charge of NZ$30 to
cover communication and courier charges.
This contract is governed in all respects by the law of New Zealand, and any
legal actions arising under the contract shall be litigated only in the
appropriate court having jurisdiction within that country. Bookings are only
accepted on these conditions and responsibilities as outlined. Payment of
deposit is deemed to be an acknowledgement of this understanding.
Prices published are in New Zealand Dollars and are subject to change. Receipt
of full payment will guarantee your holiday cost. Prices shown are valid for the
period 15 June to 06 October 2002 for Queenstown and Wanaka, and 15 June to 15
October 2002 for Methven. Prices include New Zealand Goods & Services Tax
(GST) unless otherwise stated.
An insurance levy of NZ$9 for
each sector of your trip and a CAA Domestic Passenger Levy of NZ$2 per sector is
payable in addition to the package price. These levy amounts are correct at
April 2002 (subject to change). Please confirm levy charges at time of booking.
Bookings amended, altered or cancelled after travel has commenced do not qualify
for any refund in respect of unused parts of the tour. Lift Passes are
non-refundable, non-exchangeable and not transferable. Local suppliers including
Ski Express staff are not authorised to promise or give refunds.
No refund is available for unused days and the Pass dates cannot be changed in
resort (although an extra pass can be issued for extra days purchased from your
ski host). There will be no refund if both Coronet Peak and The Remarkables are
closed in Queenstown, or if Mt Hutt in Methven is closed. On 'Closed days' a set
choice of activities will be on offer through the Ski Express Activity Centre.
The Resort Pass is non-exchangeable and not transferable. If the pass is lost
there are certain checking/indemnity procedures which must take place before a
replacement pass can be issued. The time taken for these procedures means that
it is not possible to immediately re-issue a pass. This can only be done in the
Ski Express Resort Activity Centre in Queenstown and Methven.
The Company expressly reserves the right to amend, vary or cancel any itinerary,
programme, facility or service for any reason whatsoever, and in particular the
Company expressly reserves the right in its absolute discretions to utilise
hotels, accommodation, operators or vehicles other than those named in these
itineraries. While care is taken in the selection of accommodation and other
services, no representation or guarantee is made or given as to the standard,
class or fitness for purpose of such accommodation or services. Proceedings for
damages for death or personal injury occurring by accident in New Zealand are
excluded by the operation of the Accident Rehabilitation and Compensation
Insurance Act 1992 which provides limited statutory entitlements to
rehabilitation, treatment and compensation in replacement of common law rights
of recovery. In other cases the Company's liability is limited to loss or damage
sustained by the tour participants as a result of its negligence or that of its
employees or agents and subject to the limitations imposed by the Carriage of
Air Act 1967 and the Carriage of Goods Act 1979. The Company does not accept any
liability of whatever nature for the acts, omissions, or default whether
negligent or otherwise of those airlines, coach operators, companies, hoteliers
or their person providing services in connection with the tour pursuant to a
contract between them and the tour participants and over whom the Company has no
direct or exclusive control. The Company does not accept liability in contract
or in tort for any damage, loss, delay, additional expenses or inconvenience
caused directly or indirectly by force majeure or other events which are beyond
its control, or which are not preventable by reasonable diligence on its part,
including, but not limited to, war, civil disturbance, fire, floods, atypical
weather conditions, acts of God, acts of Government or any other authorities,
accidents to or failure of machinery or equipment or industrial action. Further,
the responsibilities of the air carriers participating in the holiday are
limited as specified in their tickets, conditions of contract, conditions of
carriage and tariffs. The Company reserves the right to cancel or withdraw any
holiday or any booking made for a passenger or decline to accept or retain any
person as a member of the tour, and further shall be under no obligation or
liability to any person as a result of any inaccuracy, misdescription or changes
to any holiday or its itinerary, or for losses or additional expenses due to
delays or changes in air or other transport services, sickness, weather,
strikes, war, quarantine or other causes. Baggage and personal effects are at
the passenger's own risk through the holiday and it is the responsibility of the
passenger to effect insurance if desired. The land arrangements for each entire
holiday as specified in the itineraries represent a complete package of
arrangements and an itemisation of costs will not be rendered.
Ski areas provide snow reports indicating conditions at time of compiling. It
should be understood that Ski Express cannot under any circumstances be held
responsible for snow conditions. No holiday can be cancelled, altered or amended
once the holiday has commenced, on the basis of snow or weather conditions.
